Cypherdash is operated by Thebillionairecompany (TBC), a company established under the laws of Seychelles — the “Company”, “we”, “us”. By creating an account, ticking the acceptance box, or using the service, you (the “user”) agree to these Terms. If you do not agree, do not use the service.

1. What Cypherdash is

Cypherdash provides software and information services: live market data, trading signals, and optional automated order execution on your own third-party exchange account (e.g. Bybit) via trade-only API keys. Cypherdash is non-custodial — we never take custody of, hold, or have the ability to withdraw your trading funds. The only money we ever handle is your subscription fee.

2. Not financial advice — no advisory or fiduciary relationship

Nothing provided by Cypherdash is financial, investment, legal, accounting, or tax advice, and nothing is personalised to your circumstances. Using the service creates no advisory, fiduciary, brokerage, or agency relationship between you and the Company. Signals and automated trades are generated by software and may be wrong. You make your own decisions and are solely responsible for them. See our Risk Disclosure.

3. Assumption of risk

You understand and accept that crypto trading is high-risk and that you can lose some or all of your capital. You knowingly and voluntarily assume all risks of using the service and of any trade placed on your account, whether by you, by automation you enabled, or arising from market, exchange, network, or third-party conditions. You confirm you are using only funds you can afford to lose.

4. Your account & API keys

You must provide accurate information and keep your credentials secure. API keys you connect must be withdrawal-disabled; we verify this and reject keys that are not. You may revoke a key or cancel at any time. You are responsible for keeping your exchange account funded and for any exchange fees, funding payments, or liquidations. Your use must comply with our Acceptable Use Policy. You are responsible for activity under your account.

5. Subscriptions & payment

Paid plans are billed in USDT for fixed periods (e.g. 30 / 90 / 365 days). Crypto payments cannot auto-renew; we email a fresh invoice before expiry and access continues only if you pay it. If a plan lapses, we stop opening new trades on your account; positions already open are never force-closed by us. Refund terms are in our Refund Policy.

6. Availability, changes & force majeure

We aim for high availability but do not guarantee uninterrupted service; markets, exchanges, and third-party processors can fail or change. We may modify, suspend, or discontinue features at any time. We are not liable for any failure or delay caused by events beyond our reasonable control — including exchange or payment-processor outages, network or hosting failures, market disruption, cyber-attacks, force majeure, or changes in law or regulation.

7. Disclaimer of warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service, signals, or data will be uninterrupted, timely, secure, error-free, or profitable.

8. Limitation of liability

To the maximum extent permitted by law, the Company and its owners, shareholders, partners, directors, officers, employees, contractors, agents, affiliates, and service providers (together, the “Protected Parties”) shall not be liable for any trading or investment losses, lost profits, lost opportunity, loss of data, or for any indirect, incidental, special, consequential, exemplary, or punitive damages, arising from or related to the service — whether in contract, tort, or otherwise, and even if advised of the possibility.

To the extent any liability is not excluded, the Protected Parties’ total aggregate liability for all claims relating to the service is limited to the greater of (a) the subscription fees you paid to us in the three (3) months before the event giving rise to the claim, or (b) USD 100.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Protected Parties from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) your trades, decisions, funds, or exchange account; (c) your breach of these Terms or the Acceptable Use Policy; (d) your violation of any law or third-party right; or (e) your API keys or credentials. This obligation survives termination of your account.

10. Acceptable use & eligibility

You must be of legal age and not barred from using crypto-trading services in your jurisdiction. You agree not to misuse the service, breach its security, or use it for unlawful activity. We may suspend or terminate access for any breach; see the Acceptable Use Policy.

11. Governing law, entity & disputes

The service is operated by Thebillionairecompany (TBC), established under the laws of Seychelles. These Terms are governed by the laws of Seychelles, without regard to its conflict-of-law rules, and any dispute will be resolved exclusively in the courts of Seychelles. Nothing here limits any non-waivable rights you may have under the mandatory consumer law of your country of residence.

12. Changes, entire agreement & severability

We may update these Terms; material changes will be communicated to active customers, and continued use after a change means you accept it. These Terms, together with the Privacy, Risk, Refund, Cookie, and Acceptable Use policies, are the entire agreement between you and the Company. If any provision is held unenforceable, the rest remains in effect, and the unenforceable part is limited to the minimum extent necessary.
